1.1 These Terms govern the private-patient services we provide on a Self-Pay Treatment or Private Medical Insurance basis.
1.2 Please read them carefully before signing the Private Patient Terms and Conditions Form. They explain who we are, how we will provide services, how the contract can be changed or ended, and other important details.
1.3 Together with your Treatment Letter, any Self-Pay Treatment Quote, and the Private Patient Terms and Conditions Form, these Terms form the entire contract between you and us. By signing the Private Patient Terms and Conditions Form, you accept the contract.
1.4 “We”, “our” and “us” mean LivingCare Group Limited or any other company in the Living Care Group. “You” and “your” mean the person receiving the care and services described in the Treatment Letter.
1.5 If you sign on behalf of a child (under 18), you agree to be bound by these Terms even if the child breaches, or is not bound by, any part of them.
1.6 Words shown in bold have specific meanings set out in Clause 2.
Living Care Group – Living Care Group Limited and its subsidiaries (section 1159, Companies Act 2006).
Living Care Group Limited – Company number 07192363, registered office: 4215 Park Approach, Leeds LS15 8GB.
Facility – Any Living Care Group care facility or hospital where we provide Services.
Medical Indemnity Insurance – The Clinical Negligence Scheme for Trusts or other valid malpractice cover.
NHS – The National Health Service in the United Kingdom.
Price List – Our national list of Self-Pay Treatment prices (see [WEB ADDRESS]).
Private Medical Insurance – A policy you hold with a private medical insurer.
Private Medical Insurance Treatment – The package of Services authorised by your insurer (excluding any excess – see 6.2).
Private Patient Terms and Conditions Form – The form you sign to confirm your agreement to these Terms.
Self-Pay Treatment Quote – Our written estimate of your Self-Pay Treatment price.
Self-Pay Treatment Price – The amount you agree to pay for Self-Pay Treatment.
Self-Pay Treatment – The package of Services you pay for yourself.
Services – The assessment, diagnosis, care, treatment, procedures and other services we provide.
Terms – This document.
Treatment Letter – Our letter confirming the Services, Self-Pay Treatment Quote (if applicable) and your admission date.
3.1 We supply the Services detailed in your Treatment Letter.
3.2 We aim to provide them on the stated date, but may need to refuse, cancel or change the date for operational, technical, medical or other reasonable reasons. We will give reasonable notice and rebook where possible. If we cannot rebook within a mutually acceptable timeframe, we will refund any advance payment for un-provided Services.
3.3 Your consultant decides when you are fit for discharge. Further Services not covered by your Self-Pay Treatment Price or insurance will be charged at our standard Price List.
3.4 If you discharge yourself against advice, no further Services are included and no refund is due.
3.5 Leaving earlier than anticipated does not entitle you to a refund of any Self-Pay Treatment Price.
3.6 We need accurate information from you to provide Services. Failure to supply it may mean we cannot treat you.
3.7 You will usually attend a pre-assessment before admission. If clinically inappropriate to proceed, we will explain why.
3.8 Consultants and other practitioners are either employed by us or engaged on a sessional basis, and are covered by appropriate Medical Indemnity Insurance.
3.9 Please avoid bringing valuables or cash; we are not responsible for loss or damage.
(Applies only if you pay for your treatment yourself)
4.1 After pre-assessment we provide a Self-Pay Treatment Quote. Costs not included will be charged at our Price List.
4.2 A Quote is valid for 90 days from the date shown.
4.3 We calculate your Self-Pay Treatment Price based on:
4.3.1 your consultant’s medical advice;
4.3.2 the results of scans and diagnostic tests; and
4.3.3 the complexity of your care and treatment.
4.4 If you think an invoice is incorrect, contact us promptly so we can investigate.
4.5 You must pay the full Self-Pay Treatment Price at least seven calendar days before admission; otherwise we may refuse admission.
4.6 Payment may be made by bank transfer, cheque or card over the phone.
4.7 You do not pay for Services we fail to provide, but must pay for all Services delivered up to cancellation.
4.8 Late payments may result in suspension of Services and interest at 5 percent above Bank of England base rate.

Unless stated otherwise (for example in your Treatment Letter), the Self-Pay Treatment Price includes:

Charges for excluded items follow our Price List and are payable by you.
Only care identified at pre-assessment is included. Extra days beyond your expected discharge date will be charged per day and must be paid within 30 days of invoice.
(Applies if you pay through Private Medical Insurance)
6.1 You remain responsible for the cost of your treatment.
6.2 Where possible we will process claims directly with your insurer, subject to:
6.2.1 You supplying complete policy details and the insurer’s authorisation code.
6.2.2 The rate agreed between us and your insurer applying.
6.2.3 Any excess or shortfall being invoiced to you, payable within 30 days.
6.2.4 Queries on invoices must be raised within 14 days.
6.3 What is covered depends on your policy documents. Some treatments recommended by your consultant may not be covered.
6.4 It is your responsibility to confirm cover with your insurer. We will provide telephone access if needed.
6.5 If further treatment is required (including for complications) your insurer may not authorise it; you must arrange alternative funding before treatment.
6.6 Sundry or specialist items (e.g. crutches) may not be covered; you may need to pay for them.
6.7 Charges excluded from your policy will follow our Price List.
6.8 If you pay us directly and seek reimbursement from your insurer, the Price List applies unless another rate is agreed.
6.9 Any unpaid charges will be invoiced to you and must be settled within 30 days.
Complications can occur; your consultant will explain risks and you should read the information provided at pre-assessment.
Your Self-Pay Treatment Price covers post-operative care and medical or surgical complications related to the Services for up to 12 months after discharge provided that:
Post-operative care and complications are covered only if:
8.1 We may amend these Terms:
a) to improve clarity;
b) due to changes in law, regulation or codes of practice; or
c) to reflect developments in our Services.
8.2 New Terms apply only to new care or treatment, not to treatment already under way.
8.3 You may end treatment if you do not accept the changes – see Clause 11.
9.1 Contact us as soon as possible. We will investigate in line with our complaints procedure (ask staff or visit [WEBLINK]).
9.2 Your statutory rights for services not carried out with reasonable skill and care are unaffected.
10.1 We are not liable for failure or delay caused by events beyond our reasonable control.
10.2 We will notify you and suspend performance for the duration of the event.
10.3 You may cancel if such an event occurs and you no longer wish us to provide Services – see Clause 11.
(Applies to both Self-Pay and Private Medical Insurance patients)
11.1 You can cancel by contacting us. Cancellation charges depend on notice given:
More than 7 days before treatment/diagnostic - Full refund
Within 7 days of treatment/diagnostic - 10 percent of procedure price
11.2 Refunds (less any cancellation charge) will be made by cheque or electronic transfer to the original payer.
11.3 Out-patients appointments:
a) Cancel with at least 24 hours’ notice – no charge.
b) Cancel within 24 hours – full charge unless you re-book immediately.
c) No-show without notice – full charge.
You may rearrange an appointment twice without charge.
(Self-Pay patients)
12.1 We may cancel appointments or treatment before they start for reasons such as lack of key personnel or materials, or events outside our control.
12.2 We will try to rearrange; if unsuitable, we will refund any advance payment.
12.3 We may cancel if you fail to pay.
12.4 If we cancel an out-patients appointment you may re-book. If not, we will refund any payment within 30 days.
13.1 The contract is between you and the Living Care Group entity named in your Treatment Letter. No other person has rights under it.
13.2 We may transfer our rights and obligations to another organisation; we will inform you in writing.
13.3 If a court finds part of this contract illegal, the rest remains in force.
13.4 Delay in enforcing the contract does not waive our rights.
13.5 These Terms are governed by English law. Disputes are subject to the English courts.
13.6 Your data rights under the Data Protection Act 2018 are explained in our Data Privacy and Processing Notice (see [WEBLINK]).
